Under the old rules, there were several different Stamp Duty rates, but you as a homebuyer, paid the same rate on the whole purchase price. Under the new LBTT system buyers pay tax on amounts between bands, not on the full purchase price of a property.

read more › Rent reviews take place at whatever intervals are agreed in the lease. Their purpose is usually to adjust the rent of the accommodation at the review date, so that it accurately reflects the market value for the premises. Naturally from a landlord's point of view it is important to maximise this and from a tenant's point of view, to minimise it. Most rent reviews are upwards only i.e. the rent will not fall at review, so the rent will remain at the same level or increase. The rent review clauses in leases are often long and complicated.

read more › Business Rates are a tax on the owners and occupiers of (non-domestic) commercial property and are calculated by reference to a Rateable Value which is assessed by the Valuation Office and reviewed every 5 years. It is calculated that rates typically equate to 45% of annual rent, making it one of the largest overheads for businesses and substantially impacting on the profitability of many organisations. Rate payers have the opportunity to appeal the assessment and if it is high, we are able to reduce the valuation and hence the actual amount payable.

read more › The lease is a signed legal contract conferring rights and duties on both signatories - the landlord and tenant. If you wish to stay at your current business location, the expiry of a business lease provides an opportunity to negotiate better terms, but the grant of a new lease is not guaranteed, i.e. all of the lease terms will be negotiable and not just the rent. Unlike a rent review where just the issue of the rent is in dispute, there are indeed other points that have to be resolved relating to length of lease, repairing obligations, break clauses, etc.

read more › At the beginning of a lease, the tenant is usually required to pay a deposit in advance. The lease contains the obligations for both landlord and tenant with regard to maintenance and repair, and states the condition in which the unit should be returned at the end of the tenancy. Dilapidation is a legal term embracing all the repairs and maintenance to be carried out by a tenant, at their expense. There are usually many reasons why this can be negotiated with the landlord to either reduce the claim and subsequent financial payment to the landlord or alternatively the tenant could carry out the works themselves to a much reduced specification.

read more › Service charges are one of the principal areas for dispute between leaseholders and their landlords. Landlords are always seeking ways to enhance the value of their buildings. Problems arise when the buildings are part or fully let: Service charges are levied by landlords to recover the costs they incur in providing services to a dwelling. The charge normally covers the cost of such matters as general maintenance and repairs, insurance of the building, central heating, lifts, lighting, cleaning of common areas, etc.
